Tenant's Right to Quiet Enjoyment
As a tenant you are entitled to enjoy peace
and quiet in the property you rent and you should allow your neighbours
peace and quiet in their properties.
What you may consider a breach of quiet
enjoyment:
- frequent entry by the landlord especially without notice
- unreasonable and ongoing noise or other disturbance
- harassment or intimidation
- preventing the tenant from having guests
- intentionally removing or restricting services
- temporary discomfort or inconvenience is NOT a breach of
the covenant of quiet enjoyment
What you can do:
- notify your landlord in writing about the problem
- file a claim for damages (you may be entitled to reimbursement
for loss of use of a portion of the property)
- end your tenancy when interference is substantial enough and
not resolved
