Termination or restriction of services
or facilities
What you should know:
- landlord can not withdraw or restrict essential service if
the service is included in your tenancy agreement
- landlord may terminate or restrict non-essential services
or facility by giving 30 day, approved, written notice of the
termination or restriction
- landlord has to reduce the rent to compensate the tenant
for loss / limitation of the non-essential service / facility
Essential Services may include, but
are not limited to:
- heat, hot water, electricity
- elevator service
- maintenance of public areas of the building
- refrigerator, stove
A service or facility is not essential
when:
- tenant can obtain the service or facility or a reasonable
substitute through an alternate source
