Q: My 12 month lease was due to end on September 30th. However, my landlord and I agreed to end it a month early and signed the Mutual Agreement to End Tenancy form (RTB-8). However, I just realized that the date and time listed for the tenancy to end is listed as 1 PM on September 1st, rather than on August 31st. This was my mistake, since I filled in the form and my landlord just signed it. My question- will I be liable for any portion (or all) of September's rent because I will be occupying the apartment for some part of September? If that is the case I'd rather move out on August 31st but I have a feeling that the landlord won't agree to amend the RTB-8 form.
A: Short version? Amend the Mutual Agreement to End form. Yours is a technical point that would be quickly recognized as a simple mistake, and for which nobody in his right mind would put themselves through the hoops to argue. Identifying a date that is 24 hours out isn't worth the rigmarole of ponying up a filing fee first, setting out the paperwork, serving people, gathering up evidence, staying up into the wee hours of the night typing out forms and one's own version of events, etc., etc. I doubt that the RTO would even entertain such an application, given that the dispute resolution officer has the power to correct administrative errors such as these. And the village in Africa? They're happy once again that $20 has been sent their way. You'd be very surprised to know just how far $20 can go in their world. On their behalf - Thanks!
